Data Ownership Policy
A faculty member serving as principal investigator, as the
coordinator, or as the sponsor of a research project is strongly
encouraged to develop a written agreement at the time the project is
initiated specifying the right and responsibilities of those who are
participating in the research activity. The following guidelines will
govern such research relationships unless expressly modified by written
agreement.
- Research data, materials, or devices generated by a principal
investigator or by laboratory assistants under the direction of, or
supported by the principal investigator shall be considered the
property of the principal investigator.
- Research data, materials, or devices generated by a principal
investigator working in collaboration with one or more faculty
colleagues shall be considered the joint property of the collaborating
individuals.
- Research data, materials or devices generated by postdoctoral,
graduate students or research trainees in projects in which they had
significant intellectual input and which were performed in large part
by them or under their direction in collaboration with a principal
investigator shall be considered the joint property of the
collaborating individuals.
- Research data may not be released for publication without the
express permission of all individuals who made significant
intellectual contributions to the project. However, any individual
involved in the project may, at his/her discretion, informally discuss
the research data with other researchers and present the data at
seminars which are not published in full or in abstract form.
- Research data, materials, or devices may not be used or released
for other uses without the express permission of the major
intellectual contributors to the projects.
- When a contractual agreement is established between a principal
investigator and consultants, service facilities, or other individuals
or corporations, the data, devices, or materials remain the property
of the principal investigator and the products resulting from the
contractual relationship are the property of the principal
investigator unless otherwise specified.
For the purpose of this policy, "materials" shall include both living
and inert materials. Nothing in this policy shall be construed as
negating State, Federal or University policies regarding patent rights
or other privileges or as in any way interfering with the investigation
of alleged misconduct under the guidelines of this University. Where
research is part of a written agreement or contract agreed to by the
principal investigator, the terms of that contract with regard to
ownership of research data, materials or devices shall be followed.
